With considerable emphasis on the importance of facilitating cross-border trade within the European Union and the concern of public bodies to ensure that they obtain value for money, there is increasing awareness of the relevance of Irish and EU public procurement rules. We have significant experience in advising on Irish and EU procurement rules in the context of construction and large projects work including public hospitals, roads, and construction and engineering projects generally and in respect of commercial contracts, including in particular technology related contracts, and contracts for goods and services such as travel, health, and financial services.
We provide clients with pragmatic and practical advice as to how the procurement rules work in practice. Our experience includes:
- advising on application of the procurement rules and the appropriate procedures
- assisting with preparation of prequalification questionnaire, project information memoranda, OJEU notices and tender documentation (including the appropriate draft contract)
- advising on application of the relevant procedures (open, restricted or negotiated) particularly in light of practical difficulties which may arise depending on the facts of the particular case
- challenging, or as the case may be defending contract awards as to compliance with the procurement rules.
