Sean advises employers (both private and public sector), contractors and designers throughout numerous residential and commercial and state infrastructure developments. He advises on all aspects of construction contracts prior to and during the course of construction and on disputes especially on Alternative Dispute Resolution methods (arbitration, adjudication, mediation and conciliation).

Sean also advises foreign direct investor clients in complex development funding arrangements for residential and commercial developments.

Key highlights include advising:

  • A large scale international contractor on significant disputes relation to various projects at adjudication, mediation and conciliation.
  • A statutory body responsible for the construction of a major infrastructure project in Ireland in relation to disputes at adjudication, conciliation, and the Commercial Court arising during the course of construction.
  • A national infrastructure body on various contentious and non-contentions issues arising in relation to ongoing maintenance contracts and on closing out obligations at end of the maintenance period and handover to next generation maintenance operator.
  • A number of Irish and UK based insurers including various Lloyds’ Syndicate Insurers in a range of disputes arising from claims against architects, engineers and insurance broker professionals on construction related claims under professional indemnity policies, employers’ liability policies and public liability policies.
  • Two windfarms owners in relation to a dispute following the failure of the cable exporting energy to the national grid at separate arbitrations against the project insurers seeking to recovery under the business interruption insurance policy and the contractor responsible for the design and construction of the failed cable.
  • A public body in relation to various large scale final account disputes at conciliation.
  • Primary Health Properties REIT, on the development of a substantial number of Primary Care Centre properties in Ireland including advising on the development funding arrangement and all construction documentation.
  • Orpea, a European leader in dependency care, in respect of the funding and construction of a number of nursing/care home developments, including advising on development funding arrangements.
