Critical Changes for Secured Lending, July 2009 Some of the fundamental changes that are being made to Irish land law which have critical implications for secured lending and require urgent action by lenders. From a date that is yet to be announced but which is likely to be soon: certain of the methods for creating security on certain land will be ineffective; and significant changes will apply to mortgages in respect of “housing loans”, and unless a mortgage deed provides otherwise, these changes will generally apply to mortgages over other property.
