Expertise
The rapidly expanding volume of case law on public procurement, and the introduction of new regulations in relation to remedies mean that contracting authorities increasingly need to avail of specialist advice in their public procurement procedures in order to ensure they are in compliance with the procurement rules. We have very extensive experience in advising on the application of Irish and EU procurement rules.
Our work in this area includes:
- Advising on the application of procurement rules and the appropriate procurement strategy and procedures
- Assisting with the preparation of OJEU notices, prequalification questionnaires, project information memoranda, and tender documentation (including appropriate draft contracts)
- Advising on the application of relevant procedures (open, restricted, competitive dialogue or negotiated) particularly in light of practical difficulties which may arise in a given case
- Advice and document preparation in relation to design competitions
- Advice and document preparation in relation to framework agreements
- Assisting in the assessment of tenders in order to select a preferred bidder
- Drafting award notices, and challenging or (as the case may be) defending contract awards as regards compliance with procurement rules
